What I will be watching for

In today’s hearing, I will be watching for the Marriage Redefiners to try to distinguish their case. That is, will they try to come up with some argument that distinguishes the Proponents of Prop 8 from Proponents of other potential ballot initiatives.  If they make no attempt to do that, we might conclude that they don’t care whether they destroy the initiative process. They just want what they want, and they don’t care about collateral damage.

On the other hand, if they do make an effort to limit the impact of their request to Prop 8 and only Prop 8, that would at least show some good faith on their part.

I will be watching.

    How is the hearing going? Or is it finished by now? And when do they expect a verdict?

    Don’t forget that a great many of us WANT the Prop 8 supporters to get standing, so the Appeals Court can impose marriage equality on all 9th Circuit states. Remember Chuck Cooper’s insistence at the first hearing that it’s ok to give same-sex couples all the rights of marriage (as California already has), but not allow them to use the word marriage (“the institution is the word!”)? That didn’t play too well with any of the three judges, judging by their expressions!

    I’m not so sure I’d be rooting for the Prop 8ers to get standing. You might want to limit marriage equality to California, rather than risk spreading it to the entire 9th Circuit, or appealing it to the SCOTUS, and have them impose marriage equality on all 50 states!

    We are more than willing to go to the Supreme Court. They have already affirmed that marriage is the union of one man and one woman.
